APPROVE MINUTES
Public Hearing and First Consideration on amendments to the Linn County Unified Development Code, Case A-06-11 as follows: amendments to Article 6, Section 7 §(4) and Article 7, Section 16, Table 7-2 and Article 9, Section 3 to align Linn County’s regulations regarding Accessory Wind Turbines with the model ordinance provided by the Iowa Utilities Board, necessary to meet eligibility requirements for designation as a Small Wind Innovation Zone (SWIZ); and amendment to Article 4, Section 1 §(3)(d) to reduce the minimum number of signs required to be posted for each development proposal.
Discuss a request from Airport National Golf LLC for a determination of whether or not proposed open space meets the intent of Article 4, Section 8, §(8F)(5)(e) of the Linn County Unified Development Code.
Discuss Temporary Use Permit TU-01-12, request by Dale Bruening, Petitioner, and Larry Hess, Owner, to operate a seasonal campground on Lnencika Lane from April 1, 2012 through October 31, 2012.
Discuss and decide on Blue Zones contribution.
Discuss and decide on Additional Insurance Allowance Request by a Linn County employee (meets all criteria).

| LINN COUNTY BOARD OF SUPERVISORS CEDAR RAPIDS, LINN COUNTY, IOWA MONDAY, MARCH 12, 2012 9:00 A.M. The Board met in session at Linn County West. Present: Chairperson Oleson, Vice Chairperson Harris, Supervisors Langston and Rogers. Absent: Supervisor Barron (personal business). Board members voting “AYE” unless otherwise noted.

Bill Micheel, Planning & Development, presented a brief overview. There were no oral or written objections.
Motion by Langston, seconded by Rogers to close public hearing.

Les Beck, Planning & Development, presented a request from Airport National Golf LLC for a determination of whether or not proposed open space meets the intent of Article 4, Section 8, §(8F)(5)(e) of the Linn County Unified Development Code. Beck stated that Airport National is proposing a 10 lot subdivision on a portion of the golf course. He is asking the board to determine what it means when the open space is to be for the “benefit of the subdivision”. Staff is not clear as it looks like there are several golf course holes that occupy the open space and they are working with the owner on the plan amendment.
Mark Lemon, Owner of Airport National Golf, introduced his attorney, David Thinnes and Dick Ransom, Hall & Hall Eng. Atty. Thinnes presented a Position Statement regarding the open space along with a sample Warranty Deed. He explained that each house will back up to the golf course, giving the illusion that each backyard contains 22.1 acres of open space. In addition to owning a lot, each lot owner will have the right to use the playground area and the chipping green/short game practice area. Furthermore, each lot owner will have the right of access to the full 22.1 acres. The lot owners will be given special discounted membership status at Airport National Golf Course as well.
It was the consensus of the Board that Airport National Golf open space area meets the requirements of “benefiting the subdivision”. Carolyn Wilson, Planning & Development, presented a request for a Temporary Use Permit TU-01-12, by Dale Bruening, Petitioner, and Larry Hess, Owner, to operate a seasonal campground on Lnencika Lane from April 1, 2012 through October 31, 2012. Wilson stated that this Temporary Use has been approved by the Board since the 2008 flood to allow campers due to flooded cabins. The Board will approve on Wednesday.
The Board discussed a contribution to the blue zones if the Cedar Rapids community is selected as a Blue Zone site.
Motion by Langston, seconded by Rogers to approve a $5,000 contribution after July 1, 2012 from the Economic Development Funds to the Blue Zone contingent upon site selection. Motion by Rogers, seconded by Langston to approve Additional Insurance Allowance Request by a Linn County employee (meets all criteria).

Katie Geiken, Exec. Dir. Cedar Rapids Public Library Foundation, met with the Board to discuss the rationale for the west side library branch and explained their Vision Iowa grant application. She introduced Harriet Kalinsky, Board Member and Friends Liaison.

Supervisor Langston suggested redirecting the pledge money and suggested $2,000 additional funding which would be contingent upon a successful Vision Iowa grant. The Board will approve on Wednesday.
The Board discussed request from Prospect Meadows, Inc. to sublease land leased from Linn County pursuant to the Ground Lease between Linn County, Iowa and Prospect Meadows, Inc. dated February 8, 2012.
Jeff Clark, Asst. County Atty., stated that Prospect Meadows proposes to sublease the ground designated for a future ball field (that the county has leased to them) to a farmer for crop ground noting that there has been no earth moved and probably won’t until 2014.
Jack Roeder stated that Prairie Meadows has been approached by a local farmer about the idea to farm the ground. The reality of it is that they are behind where they thought they would be in fundraising and 2014 is a more accurate target date rather than 2013.
Jerry Acres, Co-Chair of the fundraising committee, gave an update on the fundraising process, noting that they are finalizing a steering committee and then will be in a full fundraising mode (April). He also stated they are working with the Linn County Planning & Development office on the site development plan.
Supervisor Rogers questioned the possibility of this being farmed for multiple years and how they can protect the interest of the land.
Clark recommended that Prospect Meadows advertise for competitive bids and he will draft a resolution for Board approval on Wednesday. Dan Biechler, Conservation Dir., met with the Board to discuss providing a permanent easement to the City of Hiawatha to allow the City to construct and maintain a sidewalk and trail along Boyson Road on county-owned property involving the Cedar Valley Nature Trail. The Board will approve on Wednesday.
Joi Bergman, Communications Manager, asked the Board if they wanted Linn County to participate in Earth Hour which is a worldwide event on Saturday, March 31st. Participants are to turn off lights for an hour between 8:30 – 9:30 p.m. The Board concurred with supporting Earth Hour.

The Board discussed the impact of higher fuel costs on county department’s FY 12 budgets. Also present: Dawn Jindrich, Steve Tucker, Dan Biechler, Dennis Goemaat, Tom Hardecopf, Major Riniker, Becki Woodson, Britt Hutchins and Auditor Miller. Biechler indicated that he will likely need another $48,500 for this fiscal year and Hardecopf indicated a $12,000 shortfall. Planning & Development are at 70% of their budget and are just now approaching their busier months.
Major Riniker stated that he is not so much concerned about this year but next year is a concern. Auditor Miller gave the rates that County departments pay by purchasing through the city of Cedar Rapids and suggested that more county departments piggy back with the city to get a better bulk rate.
Dawn Jindrich stated that they will need to identify where departments are saving elsewhere and who has additional revenues to help out these departments. She also asked the Board if they would want to ask departments to postpone equipment purchases until the fuel price increase are addressed.
The Board asked Jindrich to contact all county departments regarding this issue and ask what their fuel budgets are for FY 12, do they project a shortfall and can they offset the shortfall with savings in another line item. She will report back to the Board on Monday, March 19th. The Board met with Steve Tucker and Dawn Jindrich to discuss proposal from Nyhart to provide annual actuarial services for GASB 45 in the amount of $5,300. The Board will approve on Wednesday. The Board received and placed on file a letter from Congressman Bruce Braley regarding concerns over direct administrative costs appeals.
